Commissioned Artwork
Commissioned artwork remains protected by copyright.
Unless a signed commission agreement expressly states otherwise:
The client owns the physical commissioned artwork after full payment
Morgan McVay LLC retains copyright and reproduction rights
The client receives the right to display the physical artwork for personal, noncommercial purposes
The client may not reproduce, license, commercialize, distribute, or create products from the artwork
Morgan McVay LLC may photograph, document, display, publish, reproduce, license, and share the artwork and its creation process
Any confidentiality request, surprise-gift embargo, delayed publication date, or restriction on public sharing must be agreed upon in writing before the commission begins.
A request for permanent confidentiality may affect whether the commission is accepted or may require different pricing.
The signed commission agreement will control if its terms differ from these general website terms.
Reference Photographs and Client Materials
Clients submitting photographs, stories, documents, logos, designs, or other materials represent that they:
Own the materials, or
Have sufficient permission from the copyright owner or other rights holder to provide and authorize their use

Evaluate the proposed commission
Plan the composition
Create the commissioned artwork
Document the project
Communicate with the client

Unless separately authorized, submission of a photograph does not grant Morgan McVay LLC ownership of that photograph.
To the fullest extent permitted by law, the client is responsible for claims, costs, or losses arising from materials submitted without sufficient rights or permission, as further described in the signed commission agreement.
Morgan McVay LLC may decline materials that raise copyright, privacy, consent, safety, or reputational concerns.
