These Terms of Use govern access to and use of morganmcvay.com, including its artwork, photographs, videos, written content, products, services, and other materials.

By accessing, browsing, purchasing from, or otherwise using this website, you agree to these terms.

If you do not agree, please do not use the website.

Website Owner

This website is operated by:

Morgan McVay LLC
studio@morganmcvay.com

Licensing requests, copyright questions, and infringement notices may be directed to the email address above.

Ownership of Website Content

Unless otherwise stated, all original artwork, paintings, drawings, prints, photographs, videos, graphics, logos, signatures, branding, product designs, written copy, page layouts, collection materials, and other creative content displayed on this website are owned by or licensed to Morgan McVay LLC.

These materials are protected by United States and international copyright, trademark, unfair-competition, and other intellectual-property laws.

No content may be used except as expressly permitted by these terms or with prior written authorization.

Ownership of Purchased Artwork

Purchasing an original artwork, limited-edition print, open-edition print, or commissioned painting transfers ownership of the physical object only.

The purchase does not transfer:

  • Copyright

  • Reproduction rights

  • Licensing rights

  • Trademark rights

  • Commercial-use rights

  • Digital rights

  • Any other intellectual-property rights

Copyright or other intellectual-property rights will transfer only through a separate written agreement expressly signed by Morgan McVay.

Morgan McVay LLC retains all copyrights and reproduction rights in purchased artwork, including the right to:

  • Photograph the artwork

  • Display and publish it

  • Reproduce it

  • License it

  • Distribute authorized copies

  • Create prints or related products

  • Use it in portfolio, editorial, promotional, exhibition, and educational materials

  • Create authorized adaptations or derivative products

These rights remain subject to any specific confidentiality terms contained in a signed commission agreement.

Permitted Personal Use

Collectors may:

  • Display the physical artwork in a private home or personal space

  • Give or resell the physical artwork

  • Share reasonable personal photographs of the artwork with clear artist credit

  • Link to public pages of the website

  • Use built-in website or social-media sharing features

Collectors and website visitors may not, without prior written permission:

  • Reproduce artwork or website content

  • Produce or sell prints, merchandise, digital files, or copies

  • Use artwork in advertising, branding, packaging, products, publications, websites, or promotional materials

  • License or sublicense the artwork

  • Create commercial adaptations or derivative works

  • Trace, animate, recolor, crop, materially alter, or republish artwork for public or commercial use

  • Mint or sell the artwork as an NFT or similar digital asset

  • Remove or obscure the artist’s signature, copyright notice, watermark, metadata, or attribution

  • Add false attribution

  • Claim authorship

  • Suggest endorsement, affiliation, sponsorship, or collaboration without permission

  • Upload artwork for unauthorized commercial reproduction

  • Use artwork in connection with unlawful, hateful, defamatory, deceptive, or infringing activity

Crediting or tagging the artist does not replace the need to obtain permission.

Commercial licensing may be available under a separate written agreement.

Website Images and Social Sharing

You may share an unaltered link to a public page of this website or use built-in sharing tools.

Except where legally permitted, you may not download, screenshot, copy, scrape, repost, publish, embed, distribute, or display website images or content on another website, account, platform, publication, marketplace, product, or promotional material without prior written permission.

Personal social sharing of a purchased artwork is permitted when:

  • The artwork is photographed in the collector’s possession

  • The image is not used commercially

  • The artwork is not materially altered

  • Reasonable credit is given to Morgan McVay

Artificial Intelligence and Machine Learning

To the fullest extent permitted by law, artwork, photographs, videos, written content, metadata, product descriptions, and other materials from this website may not be:

  • Scraped

  • Downloaded

  • Copied

  • Ingested

  • Mined

  • Labeled

  • Analyzed

  • Used as reference material

  • Included in a dataset

  • Used to create prompts, embeddings, models, style replicas, or adaptations

  • Used to train, fine-tune, test, benchmark, evaluate, develop, or operate artificial-intelligence or machine-learning systems

No license is granted for generative-AI use, text-and-data mining, machine learning, automated extraction, or model development.

This prohibition applies to direct use and to use through intermediaries, datasets, automated tools, contractors, or third-party platforms.

Automated Access and Scraping

You may not use bots, crawlers, scrapers, automated agents, browser automation, data-mining tools, or similar technologies to access, collect, monitor, index, copy, reproduce, or extract website content without prior written authorization.

Standard search-engine indexing performed in accordance with publicly communicated technical instructions is excluded from this prohibition.

You may not bypass, disable, interfere with, or evade access restrictions, security features, rate limits, robots instructions, or other technical measures.

Commissioned Artwork

Commissioned artwork remains protected by copyright.

Unless a signed commission agreement expressly states otherwise:

  • The client owns the physical commissioned artwork after full payment

  • Morgan McVay LLC retains copyright and reproduction rights

  • The client receives the right to display the physical artwork for personal, noncommercial purposes

  • The client may not reproduce, license, commercialize, distribute, or create products from the artwork

  • Morgan McVay LLC may photograph, document, display, publish, reproduce, license, and share the artwork and its creation process

Any confidentiality request, surprise-gift embargo, delayed publication date, or restriction on public sharing must be agreed upon in writing before the commission begins.

A request for permanent confidentiality may affect whether the commission is accepted or may require different pricing.

The signed commission agreement will control if its terms differ from these general website terms.

Reference Photographs and Client Materials

Clients submitting photographs, stories, documents, logos, designs, or other materials represent that they:

  • Own the materials, or

  • Have sufficient permission from the copyright owner or other rights holder to provide and authorize their use

Clients are responsible for obtaining permission from professional photographers when required, including wedding, portrait, travel, real-estate, architectural, and event photographers.

By submitting reference materials, the client grants Morgan McVay LLC a limited, nonexclusive right to use those materials to:

  • Evaluate the proposed commission

  • Plan the composition

  • Create the commissioned artwork

  • Document the project

  • Communicate with the client

  • Fulfill the commission

  • Maintain business and dispute records

Unless separately authorized, submission of a photograph does not grant Morgan McVay LLC ownership of that photograph.

To the fullest extent permitted by law, the client is responsible for claims, costs, or losses arising from materials submitted without sufficient rights or permission, as further described in the signed commission agreement.

Morgan McVay LLC may decline materials that raise copyright, privacy, consent, safety, or reputational concerns.

Trademarks and Branding

Morgan McVay, Morgan McVay Art, associated signatures, logos, collection names used as source identifiers, and other distinctive branding may be protected by trademark, unfair-competition, or related laws.

Nothing on this website grants permission to use the studio name, artist signature, logo, branding, or other identifiers in a manner that suggests endorsement, sponsorship, affiliation, authorization, or collaboration.

However:

  • Colors may vary by screen or lighting

If there is a conflict, the more specific signed commission agreement or product-specific written term will control.
